These Terms and Conditions apply primarily to customers purchasing goods as consumers. A consumer is an individual acting outside the scope of their business or professional activity.
2. General Provisions
These Terms and Conditions govern the contractual relationship between the Seller and the Customer arising from purchases made through the Seller's online store.
By submitting an order, the Customer confirms that they have had the opportunity to read these Terms and Conditions, the Privacy Policy, the Returns & Claims Policy and the Shipping & Payment information before completing the purchase.
The contractual relationship is governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and, where applicable, Act No. 634/1992 Coll., on Consumer Protection.
Mandatory consumer rights applicable under Czech or European Union law remain unaffected.
3. Products
RADKA SIRKOVA offers fashion garments, accessories and related products. Some products may be produced in limited quantities, made to order or individually altered.
Product photographs and descriptions are intended to represent the products as accurately as reasonably possible. Due to the nature of fabrics, handcrafted production, individual screens and photography, minor variations in colour, texture or appearance may occur.
Such minor variations do not constitute a defect where the product otherwise corresponds to the agreed characteristics.
The Customer is responsible for selecting the appropriate size and, where applicable, providing correct measurements or other information required for individual alterations.
4. Prices
Prices displayed in the online store are the prices applicable at the time the order is placed. Any additional delivery costs are displayed before the order is submitted.
For deliveries outside the European Union, customs duties, import taxes, local taxes or handling charges may apply. Unless expressly stated otherwise, such charges are not included in the purchase price or shipping price and are the responsibility of the Customer.
5. Orders and Conclusion of the Purchase Contract
The Customer places an order by selecting the desired products and completing the online checkout process. Before submitting the order, the Customer has the opportunity to review and correct the information entered.
By submitting an order using a button or other function clearly indicating an obligation to pay, the Customer submits a binding order. The Seller will confirm receipt of the order electronically to the e-mail address provided by the Customer.
Unless expressly stated otherwise during checkout, the purchase contract is concluded when the Seller confirms acceptance of the Customer's order.
The Seller may contact the Customer if additional information is necessary to process the order, particularly in relation to measurements, individual alterations, product availability or delivery.
The Seller may refuse or cancel an order where there is a legitimate reason to do so, for example where the product is unavailable, an obvious pricing error has occurred, payment has failed or the order cannot reasonably be fulfilled. If payment has already been received, the relevant amount will be refunded without undue delay.
6. Payment
The Customer may use the payment methods currently offered during checkout. Payment must be completed in accordance with the conditions of the selected payment method.
The Seller is not responsible for additional charges imposed directly by the Customer's bank, card issuer or payment provider, including currency conversion charges.
7. Delivery
Available delivery methods, destinations and delivery costs are displayed during checkout.
Delivery times may vary depending on product availability, destination, delivery method and whether the product requires individual production or alteration.
Unless another delivery period has been agreed, the Seller will deliver the goods without undue delay and within the period required by applicable law.

8. Right of Withdrawal
A Customer purchasing as a consumer through the online store generally has the right to withdraw from the purchase contract without giving a reason within 14 days of receiving the goods, unless a statutory exception applies.
The Customer may exercise this right by sending an unequivocal statement of withdrawal to the Seller.

9. Individually Altered and Bespoke Products
The statutory right of withdrawal does not apply where goods have been genuinely made according to the Customer's individual specifications or clearly personalised to the Customer's personal needs, where the statutory conditions for this exception are met.
This may include, for example, a garment individually produced or materially altered according to measurements or specifications supplied by the Customer.
The exception does not automatically apply merely because the Customer chooses a standard size, colour, fabric or another option from alternatives normally offered by the Seller.
Where a product is to be individually altered or made according to the Customer's personal specifications in a manner that excludes the statutory right of withdrawal, the Customer will be informed accordingly before the relevant work is undertaken.
11. Intellectual Property
All content on www.radkasirkova.com, including photographs, garment designs, texts, graphics, logos, trade names, product names and other creative content, is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified or commercially used without the prior consent of the relevant rights holder, except where permitted by law.
12. Personal Data
Personal data is processed in accordance with applicable data protection legislation, including Regulation (EU) 2016/679 (GDPR).

13. Alternative Dispute Resolution
If a consumer dispute arising from a purchase cannot be resolved directly with the Seller, the consumer may apply for alternative dispute resolution to:

14. Governing Law
Purchase contracts concluded through the online store and these Terms and Conditions are governed by the laws of the Czech Republic.
Where the Customer is a consumer resident in another country, this choice of law does not deprive the Customer of mandatory consumer protection afforded by the law that would otherwise apply.
15. Final Provisions
The Seller may amend these Terms and Conditions from time to time. The version applicable to a particular order is the version effective at the time the order was placed.
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, this does not affect the validity of the remaining provisions.
