RETURNS & CLAIMS POLICY

1. 14-Day Right of Withdrawal

If you are a consumer and purchase standard goods through our online store, you generally have the right to withdraw from the purchase contract without giving a reason within 14 days from the date on which you, or a third party designated by you other than the carrier, receive the goods.

Where a single order is delivered in several separate deliveries, the withdrawal period generally begins upon receipt of the last item or part, as provided by applicable law. You may also withdraw before the goods have been delivered.

To exercise your right of withdrawal, send us an unequivocal statement informing us of your decision to withdraw from the contract at info@radkasirkova.com.

You may use the Model Withdrawal Form below, but its use is not mandatory.

2. Returning the Goods

After notifying us of your withdrawal, you must return the goods without undue delay and no later than 14 days after notifying us of the withdrawal.
 

Unless otherwise agreed, the direct cost of returning the goods is borne by the Customer.
 

Returned goods should be appropriately packed to prevent damage during transport. The Customer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
 

Trying on a garment in a manner comparable to trying it on in a physical store does not in itself remove the consumer's statutory right of withdrawal.
 

Please contact us before returning goods so that we can provide the appropriate return instructions.

4. Bespoke and Individually Altered Products

The statutory 14-day right of withdrawal does not apply where goods have been genuinely made according to the Customer's individual specifications or clearly personalised to their personal needs, provided the statutory requirements for this exception are met.

This may include garments individually made or materially altered according to measurements or specific requirements supplied by the Customer.

However, the exception does not automatically apply simply because a Customer has selected a standard size, colour, material or other option from alternatives normally offered by RADKA SIRKOVA.

Where an order involves individual production or alteration that results in the statutory right of withdrawal being excluded, we will inform the Customer accordingly before the relevant work is undertaken.

This exception concerns withdrawal without giving a reason. It does not remove the Customer's statutory rights where individually produced or altered goods are defective.

5. Defective Goods

The Seller is responsible for ensuring that goods conform to the purchase contract at the time of delivery.

A consumer may assert statutory rights in respect of a defect that becomes apparent within two years of receipt of the goods.

Where a defect becomes apparent within one year of receipt, the applicable statutory presumption concerning the existence of the defect at the time of receipt applies, unless incompatible with the nature of the goods or defect.

Normal wear and tear, damage caused by improper use, accident, failure to follow reasonable care instructions or damage caused by the Customer does not constitute a defect for which the Seller is responsible.

6. Remedies for Defective Goods

Where goods are defective, the consumer may request that the defect be remedied, in particular by repair or replacement, subject to the conditions and limitations provided by applicable law.

The Seller may refuse the Customer's chosen remedy if it is impossible or disproportionately costly compared with another available remedy, taking into account all relevant circumstances.

Where the statutory conditions are met, the consumer may also be entitled to a reasonable reduction in the purchase price or to withdraw from the purchase contract.

Nothing in this policy limits statutory consumer rights.

7. How to Make a Claim

When making a claim, please provide, where possible:

  • your name and contact details;

  • order number or other proof of purchase;

  • identification of the relevant item;

  • a description of the defect;

  • photographs where useful;

  • your preferred remedy.

The Customer does not necessarily need to provide the original receipt if the purchase can be reliably demonstrated by another method.

8. Handling of Claims

When a consumer makes a claim, the Seller will provide confirmation stating when the claim was made, its content and the remedy requested, as required by applicable law.

Consumer claims will be assessed and resolved without undue delay. Unless the Seller and the consumer agree on a longer period, the claim, including removal of the defect where applicable, must be resolved and the consumer informed of the outcome no later than 30 days from the date on which the claim was made.

Where a claim is justified, the consumer is entitled to reimbursement of reasonable costs necessarily incurred in exercising their statutory rights.

9. Alternative Dispute Resolution

If a consumer dispute cannot be resolved directly with us, the consumer may apply for alternative dispute resolution to:
